1. Acceptance of Terms

By downloading, installing, or using the SnowRun mobile application (“App”) or accessing the SnowRun website at getsnowrun.com (“Website”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App or Website.

These Terms constitute a legally binding agreement between you and ThamesCo (“we,” “us,” or “Company”).

2. Eligibility

You must be at least 16 years of age to use SnowRun. By using the App, you represent and warrant that you meet this age requirement. If you are between 16 and 18 years of age (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Account Registration

To access certain features of the App, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Promptly update your information if it changes
• Accept responsibility for all activity that occurs under your account

You may not create an account using false or misleading information, or on behalf of another person without their permission. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Fees and Subscriptions

SnowRun offers both free and paid features. Paid features are available through the following subscription plans and in-app purchases:

Snowmile Packs — consumable in-app currency available in various quantities at prices displayed in the Apple App Store or Google Play Store.

4.3 Auto-Renewal and Cancellation

All subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. You can manage and cancel your subscription at any time through your Apple App Store or Google Play Store account settings.

If you are on a free trial, you will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the applicable rate.

4.4 Payment and Refunds

Payment is processed through the Apple App Store or Google Play Store. All prices are in US dollars and may vary by region due to local taxes and currency conversion. Refund requests must be directed to Apple or Google in accordance with their respective refund policies.

5. Use License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a device that you own or control, solely for your personal, non-commercial use.

You may not:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse-engineer or attempt to extract the source code of the App
• Use the App to develop a competing product or service
• Remove, alter, or obscure any proprietary notices in the App
• Use automated systems (bots, scrapers) to access the App

6. User Conduct

When using SnowRun, you agree not to:

• Violate any applicable laws, regulations, or third-party rights
• Upload or transmit content that is harmful, abusive, threatening, defamatory, or otherwise objectionable
• Interfere with or disrupt the operation of the App or its infrastructure
• Attempt to gain unauthorized access to other users' accounts
• Use the App to harass, stalk, or harm other users
• Submit false, misleading, or spam content (including fabricated GPS tracks or issue reports)
• Impersonate any person or entity

7. Location and GPS Disclaimer

SnowRun uses GPS and location data to provide ski run tracking, resort mapping, and navigation features. You acknowledge and agree that:

• GPS data may be inaccurate due to environmental factors such as weather, terrain, signal obstruction, or device limitations
• The App is not a substitute for proper safety equipment, trail markers, avalanche beacons, resort staff guidance, or professional instruction
• Resort maps and trail data are provided for informational purposes only and may not reflect current conditions, closures, or hazards
• Navigation and route guidance are provided on a best-effort basis and may not always reflect safe or passable routes. We are not responsible for any injury, loss, or damage resulting from following navigation suggestions, including but not limited to routes that lead to unsafe terrain, closed areas, or off-piste locations
• You are solely responsible for your safety and for making prudent decisions while skiing, snowboarding, or engaging in any winter sport
• Emergency contact and patrol phone features are provided as a convenience and should not be relied upon as the sole means of emergency communication

8. Assumption of Risk

Skiing, snowboarding, and other winter sports are inherently dangerous activities that involve significant risk of serious injury or death. By using SnowRun, you acknowledge and accept these risks.

To the maximum extent permitted by applicable law, you assume full responsibility for any injury, loss, or damage arising from your participation in winter sports while using the App. The App is a tracking and informational tool only and does not guarantee your safety in any way.

Nothing in this section is intended to exclude or limit any liability that cannot be excluded or limited under applicable consumer protection law.

9. Intellectual Property

The App, Website, and all related content, features, and functionality (including but not limited to design, text, graphics, logos, icons, images, software, map data, and curated resort information) are owned by ThamesCo and are protected by international copyright, trademark, and other intellectual property laws.

“SnowRun,” the SnowRun logo, and the Yuki mascot character are trademarks of ThamesCo. You may not use these marks without our prior written consent.

10. User Content

You retain ownership of any content you submit through the App, including GPS tracks, issue reports, profile photos, and other user-generated content (“User Content”).

By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display your User Content solely for the purpose of operating, improving, and providing the SnowRun service.

This license terminates when you delete your User Content or your account, except where your content has been shared with other users (such as community GPS tracks) and those users have not deleted their copies.

You represent and warrant that you have the right to submit any User Content and that it does not infringe upon the rights of any third party.

11. Third-Party Links and Services

The App may contain links to third-party websites, services, or promotions that are not owned or controlled by us. We are not responsible for the content, privacy policies, or practices of any third-party sites or services. Your use of third-party services is at your own risk and subject to those third parties' terms and conditions.

12. Limitation of Liability

To the maximum extent permitted by applicable law, ThamesCo and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or in connection with your use of the App, whether based on warranty, contract, tort (including negligence), or any other legal theory.

In no event shall our total aggregate liability exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) USD $50.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law. Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless ThamesCo and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the App; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any third-party rights.

This indemnification obligation applies only to the extent permitted by the laws of your jurisdiction. In jurisdictions where consumer indemnification clauses are restricted, this section shall apply only to the extent allowed by applicable law.

14. Account Termination and Deletion

You may delete your account at any time by contacting us at support@getsnowrun.com . Upon receiving your deletion request, we will delete your account and associated personal data within 30 days.

We may suspend or terminate your account if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or if required to do so by law. We will make reasonable efforts to notify you prior to termination, except where immediate action is necessary.

Accounts that have been inactive for 24 consecutive months may be flagged for deletion. We will send a notification to your registered email address at least 30 days before deleting an inactive account.

15. Modifications to Terms

We may update these Terms from time to time. If we make material changes, we will provide at least 30 days' notice through the App (via an in-app notification) or by email to the address associated with your account.

Your continued use of the App after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree to the updated Terms, you should stop using the App and delete your account.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.

If you are a resident of the European Union, European Economic Area, or the United Kingdom, nothing in these Terms affects your right to rely on any mandatory provisions of the consumer protection law of the country in which you reside. You may also bring proceedings in the courts of the country in which you reside.

17. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be limited or severed to the minimum extent necessary, and the remaining provisions of these Terms shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy , constitute the entire agreement between you and ThamesCo regarding your use of the App and supersede any prior agreements or understandings.
